Terms of Service

This is an agreement between you (the "user") and Koda (a personal project by Oleksandr Zinchenko, Ukraine). By using Koda, you agree to the terms below. If anything does not work for you, do not use the service, or write to support.koda@gmail.com.
1. Who can use Koda
Koda is intended for people aged 13 and older. If you are under 18, make sure your parents or legal guardians are aware of your use of the app, especially when it comes to payments.
2. Your account
Sign-in is via Google Sign-In. You are responsible for the security of your Google account: anyone who gains access to it will also have access to your Koda. We do not store passwords — Google manages them.
One account = one person. Sharing an account within a single family is allowed, but not for commercial use by multiple people at the same time.
3. What is yours, what is ours
- Your content (habits, tasks, events, files) belongs to you. We only provide the infrastructure for storage.
- The app, design, logo, and Koda brand belong to us. You may not copy, modify, or pass it off as your own product.
- Feedback you send (reviews, ideas, bugs) — we may freely use it without compensation.
4. Subscriptions and payments
Koda offers three options:
- Free — free forever, with a limit of 4 active habits. Tasks and calendar are unlimited.
- Pro — $2.99/month or $19.99/year, with a 7-day free trial. Removes the habit limit, adds Google Calendar sync, customization, and Pro stats.
- Lifetime — $39.99 one-time (for the first 500 buyers). All Pro features forever + AI coach (from Phase 4) with a limit of 50 requests per day.
All payments are processed through Google Play Billing. Subscriptions auto-renew until you cancel via Google Play settings. Prices are in US dollars; local currency and taxes are added by Google.
5. Refunds
- Within 2 hours of purchase — instant automatic refund via Google Play (standard Google policy)
- Within 48 hours of purchase — refund on request via Google Play Help (Google reviews each case)
- Within 14 days for EU buyers, in accordance with EU Directive 2011/83/EU on consumer rights — write to support, we will refund regardless of Google's policy
- Beyond these windows — write to support; we will consider individually (especially if the issue is technical on our side)
Lifetime $39.99 is refundable under the same conditions as other one-time purchases.
6. AI coach (from Phase 4)
In the future, Koda will add an AI coach based on the methodologies of Atomic Habits and The Power of Habit. Access is for Lifetime subscribers and optionally as an add-on. The limit of 50 requests per day exists so that operational costs remain stable.
The AI coach provides general suggestions and structure, not medical or psychological advice. If you have questions about your health, depression, or any other serious condition, consult a specialist, not an app.
7. What you may not do
- Store illegal, abusive, or harmful content
- Attempt to circumvent Free-tier limits, reverse-engineer the app, or exploit vulnerabilities
- Create multiple accounts to circumvent Free-tier limits
- Use Koda for spam, mass mailings, automated bots
- Resell, sublicense, or host Koda for others
If you find a security bug, please do not exploit it — write to support. Thank you.
8. Service availability
We do our best to keep Koda running 24/7, but we do not guarantee uninterrupted operation. Scheduled updates, downtime caused by Supabase, Google, or other dependencies we cannot influence immediately may occur.
As a safety net, Koda works offline on your device. Sync will happen once the network is back.
9. Disclaimer
Koda is a tracking tool — not a doctor, coach, or guarantor. It cannot force you to perform habits or diagnose a mental state. Results depend on you.
The service is provided "as is", without warranties of fitness for a particular purpose, except those expressly required by law.
10. Limitation of liability
To the extent permitted by law, Koda is not liable for indirect, incidental, or consequential damages (lost profits, data loss, psychological discomfort from missed habits). The maximum aggregate liability is limited to the amount you paid for the subscription in the last 12 months.
This limitation does not apply to gross negligence or willful violation of the law on our part.
11. Suspension and termination
You can delete your account at any time via Settings → Delete account.
We may suspend or remove your account if you violate these terms (particularly section 7). In most cases, we will warn you by email first.
If the Koda project ceases to exist, we will notify you at least 60 days in advance and provide a way to export all your data.
12. Changes to these terms
We may update these terms. The date at the top reflects the most recent revision. We will notify you in-app or by email about material changes (especially those affecting payments) at least 14 days before they take effect.
13. Pre-court dispute resolution
Before going to court, we ask you to first write to support.koda@gmail.com describing the issue. We commit to responding within 30 days and trying in good faith to resolve the dispute — in most cases this is faster, cheaper, and more effective than litigation.
14. Governing law
These terms are governed by the laws of Ukraine, without giving effect to its conflict-of-laws rules. Disputes that cannot be resolved out of court are referred to the competent courts of Ukraine — except where mandatory provisions of the law of your country (especially in the EU) grant you the right to bring proceedings in your local courts at your place of residence.
15. For EU consumers
Nothing in these terms limits your rights as a consumer under the mandatory provisions of your EU country's law. In particular, you retain the right to a 14-day withdrawal in accordance with Directive 2011/83/EU.
The European Commission provides an Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr. Koda is not obligated and does not agree to participate in alternative dispute resolution through a specialized body, but we are open to pre-court resolution via support.
16. Export control and sanctions
By using Koda, you confirm that (a) you are not located in a country subject to US or EU government sanctions; (b) you are not on any list of restricted or denied parties (US Treasury OFAC SDN, EU consolidated list); (c) you will not use Koda for activities prohibited by the laws of Ukraine, the EU, or the US regarding export control.
17. Platform-specific terms
Koda is distributed through Google Play (and in the future, the App Store). Your relationship with the platform is additionally governed by that platform's own terms (Google Play Terms of Service, Apple Media Services Terms). In case of direct conflict between our terms and the platform's terms regarding payments or distribution, the platform's terms apply.
If you purchase a subscription or Lifetime through the App Store, Apple is the end-seller in accordance with Schedule 2 of the Apple Developer Program License Agreement; refunds are governed by Apple's policy.
18. Beta versions and early access
Some Koda features may be available in beta testing format (e.g., via TestersCommunity or Google Play Internal Testing). Beta features are provided "as is", without guarantees of stability or data retention, and may be changed or removed without notice. We may freely use feedback from beta testing without additional consent or compensation.
19. Force majeure
Koda is not liable for non-performance or delay in performance of its obligations caused by circumstances beyond our reasonable control — including but not limited to: war, martial law, natural disasters, power or internet outages, cyber-attacks, failures of infrastructure providers (Supabase, Google), government restrictions, pandemics.
20. Severability
If any provision of these terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by one that most closely reflects the original economic intent of the parties within the bounds of the law.
21. Waiver
Our failure to insist on immediate enforcement of any provision of these terms shall not constitute a waiver of our right to insist on it later. Any waiver of a right under these terms is only effective if set out in writing and signed by us.
